By accessing or using our web application at habithuddle.com, our mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Habit Huddle. By creating an account or using our Service, you represent that you have the legal authority to enter into these Terms.

Habit Huddle is a habit tracking and community platform that allows users to:

  • Track daily habits and goals
  • Join community groups called "huddles" for accountability and support
  • Create and share habit templates
  • Access analytics and progress insights
  • Participate in seasonal competitions and leaderboards
  • Use AI-assisted habit creation tools (Pro feature)
  • Access premium features through paid subscriptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration and to keep your account information current.

You agree that your User Content will not:

  • Contain harmful, threatening, abusive, harassing, or discriminatory content

4.3 Community Guidelines

Habit Huddle is built on community support and accountability. We expect all users to:

  • Be respectful and supportive of other users
  • Provide honest and accurate check-ins
  • Respect the privacy and boundaries of others
  • Report inappropriate behavior or content
  • Use huddles for their intended purpose of habit building and support

5. Child Safety Standards

5.1 Zero Tolerance Policy

Habit Huddle maintains a zero tolerance policy against child sexual abuse and exploitation (CSAE). We are committed to providing a safe environment for all users and strictly prohibit any content, conduct, or activities that could harm minors.

5.2 Prohibited Content and Conduct

The following are strictly prohibited on our platform:

  • Any content that sexualizes, exploits, or endangers minors
  • Sharing, distributing, or soliciting child sexual abuse material
  • Inappropriate communication with or targeting of minors
  • Grooming behavior or attempts to exploit minors
  • Content that promotes or facilitates harm to children
  • Any activity that violates laws protecting minors

5.3 Age Verification and Restrictions

Users must be at least 13 years old to use our Service. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to remove such information and terminate the account.

6. Subscription and Payment Terms

6.1 Pro Subscription

Our Pro subscription provides access to premium features including AI-assisted habit creation, advanced analytics, unlimited huddles, streak freezes, and other enhanced functionality. Subscription fees are billed in advance on a monthly or annual basis.

6.2 Payment Processing

Payments are processed through secure third-party payment processors. By subscribing, you authorize us to charge your chosen payment method for the subscription fees and any applicable taxes.

6.3 Billing and Renewal

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You can cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of the current billing period
  • We reserve the right to suspend or terminate service for non-payment

6.4 Price Changes

We reserve the right to change subscription prices at any time with reasonable notice. Price changes will apply to subsequent billing periods.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Habit Huddle and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Privacy and Data Protection

11.2 Health and Wellness Disclaimer

Habit Huddle is not a medical or therapeutic service. The Service is designed for general habit tracking and community support. Always consult with qualified healthcare professionals for medical advice, diagnosis, or treatment.

11.3 Limitation of Liability

To the maximum extent permitted by law, Habit Huddle shall not be liable for any damages of any kind, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Habit Huddle and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration or in courts of competent jurisdiction, at our sole discretion.
